• Treat our installation personnel with respect and provide a safe working environment.

3. Service Limitations

Our window installation services are subject to the following limitations:

• Service availability depends on geographic location, weather conditions, and personnel availability;
• We reserve the right to refuse service if installation conditions present safety hazards;
• We cannot guarantee exact color matching with existing structures in all cases;
• Installation timelines may vary based on unforeseen structural issues discovered during installation;
• Additional charges may apply for installations requiring special equipment or techniques not specified in the original quote;
• We are not responsible for pre-existing structural defects that may become apparent during installation.

4. Intellectual Property

All content on the Website, including but not limited to text, graphics, logos, images, videos, and software, is the property of zycynyi.com and is protected by intellectual property laws. You may not reproduce, distribute, modify, display, or create derivative works from any material on our Website without our express written consent.

The trademarks, service marks, and logos used and displayed on the Website are registered and unregistered trademarks of zycynyi.com. Nothing on the Website should be construed as granting any license or right to use any trademark without our prior written permission.

5. Liability Limitations

To the maximum extent permitted by law, zycynyi.com and its affiliates, officers, employees, agents, and partners shall not be liable for:

• Any indirect, incidental, special, consequential, or punitive damages arising out of or related to the use of our Services;
• Any damages resulting from delays in service provision due to circumstances beyond our reasonable control;
• Issues arising from pre-existing property conditions not visible during initial assessment;
• Damages to personal property that was not removed from the installation area despite instructions to do so;
• Any loss or damage exceeding the amount paid by you for the specific Services giving rise to the claim.

Our total liability for any claim arising out of or relating to these Terms and Conditions shall not exceed the total amount paid by you for the Services within the twelve (12) months preceding the claim.

6. Dispute Resolution

Any dispute arising from or relating to these Terms and Conditions or our Services shall be resolved as follows:

• We encourage you to contact us first to attempt to resolve any issues informally;
• If informal resolution is unsuccessful, all disputes shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association;
• The arbitration shall be conducted in the jurisdiction where our main office is located;
• The arbitration shall be conducted by a single arbitrator with experience in construction and contract law;
• The arbitrator's decision shall be final and binding on all parties;
• Each party shall bear its own costs of arbitration, except that the arbitrator may award costs and attorneys' fees to the prevailing party.

You agree to waive any right to participate in class actions or class-wide arbitration. Any claim must be brought in your individual capacity.

7. Warranty and Guarantees

Our window installation services come with a limited warranty as specified in your service agreement. This warranty covers workmanship and installation defects for the period stated in your contract. The warranty does not cover damage resulting from improper use, natural disasters, or normal wear and tear.

Product warranties for windows and materials are provided by the manufacturers and are separate from our installation warranty. We will assist with processing manufacturer warranty claims but cannot extend or modify manufacturer warranties.

8. Cancellation and Rescheduling

Cancellation or rescheduling requests must be submitted at least 48 hours before the scheduled installation. Late cancellations may incur a fee as specified in your service agreement. We reserve the right to reschedule installations due to inclement weather or other circumstances that may affect installation quality or safety.

9. Modifications to Terms

We reserve the right to modify these Terms and Conditions at any time. Changes will be effective immediately upon posting to the Website. Your continued use of our Services after any modifications indicates your acceptance of the revised Terms and Conditions.

10. Governing Law

These Terms and Conditions shall be governed by and construed in accordance with the laws of the jurisdiction where our main office is located, without regard to its conflict of law provisions.
